An out-of-province judge has been brought in to deal with a Fredericton man who threatened a local judge with violence last month in open court.
Joshua Daniel Grant Burden, 48, of no fixed address, faces a variety of criminal charges alleging offences between April and June.
His recent appearances in Fredericton provincial court - by telephone and video-conferencing - have been marked by his angry outbursts, rants, profanity and demands to be released from custody.
During another such tumultuous appearance June 19, Fredericton provincial court Judge Scott Brittain ruled on Burden’s bail hearing, denying his release from custody pending the outcome of his charges.
“If you keep fucking with me, you should be worried about what I’m going to do to you,” the defendant told Brittain at that time.
“I’ll meet you in the parking lot at the courthouse and punch your fucking face off!”
Burden now faces counts of uttering threats to Brittain, attempting to intimidate a justice-system participant and breaching his probation as a result of those outbursts.
The accused appeared again in Fredericton provincial court by video from the jail in Saint John on Thursday, but so did the judge now handling his case.
Judge Diane McGrath, with the Nova Scotia provincial court, presided over the Burden matter as a result of the charges against Burden stemming from his conduct toward Brittain.
Thursday’s proceedings were meant to be a fitness hearing, as Burden had been ordered to undergo a psychiatric assessment.
However, things didn’t go any better Thursday than on previous occasions.
McGrath began to ask a question of Crown prosecutor Blake Johnston, referring to him as “Mr. Johnston,” but Burden thought the judge was talking to him and was using the wrong name.
“My name is Joshua Burden, and I’m a Hells Angel,” he declared. “My name isn’t fucking Josh Johnston!”
McGrath tried to explain to him that she’d been talking to the prosecutor, but Burden - clad in orange jail-issued sweats and sitting close to the camera - kept cursing and yelling at her.
Johnston suggested if Burden wasn’t prepared to participate in his fitness hearing, it might be best to adjourn it.
“Yes, I think he should be moved to his cell,” the Nova Scotia judge said.
The court stenographer then shut down the video-conference interface.
Burden previously underwent a five-day psychiatric assessment in June while remanded at the Saint John Regional Correctional Centre, which found him fit to stand trial.
However, Judge Lucie Mathurin ordered a more in-depth fitness assessment last month, to be conducted at the Restigouche Hospital Centre, a secure psychiatric facility in Campbellton.
When the proceeding reconvened later Thursday afternoon, McGrath, appearing by phone from Nova Scotia, noted she’d directed to have Burden’s audio muted.
The judge said she’d been prepared to avail herself of a Section 650 (2) of the Criminal Code of Canada to remove Burden from the proceedings altogether.
That rarely used section states: “The court may… cause the accused to be removed and to be kept out of court, where he misconducts himself by interrupting the proceedings so that to continue the proceedings in his presence would not be feasible.”
McGrath said she’d received the psychiatric report from the Restigouche Hospital Centre, and Johnston and duty counsel Edward Derrah noted they’d received and reviewed it as well.
“I certainly didn’t see anything in there that would allow the court to make a consideration of unfit,” the judge said.
Derrah said he’d reviewed the report with Burden, noting the defendant doesn’t take any issue with the findings contained therein.
McGrath then pointed out there was another snag with the case. She said she’s been appointed to preside over the June 19 charges only, not those that allege offences earlier in the year.
Before the events of June 19 in court, Burden stood accused of breaking into City Auto on Main Street and stealing a vehicle belonging to Nicolas McPhee on April 19; sexually assaulting a woman June 6; and uttering threats to Eric Lanteigne and Terri-Lynn Stewart at the Oak Centre on June 7, as well as breaching a police undertaking prohibiting him from contact with the complainant in the sex-assault count on that date.
He’s also charged with violating his probation on those occasions as well.
The name of the sexual-assault complainant is protected by a court-ordered publication ban.
McGrath said she’s also learned there’s an outstanding issue of a bail hearing.
Court heard that while Brittain denied Burden’s release on the earlier charges, the defendant has yet to have a bail hearing on the June 19 matters.
“It is a tricky situation,” said Johnston, though he noted that since Burden is already remanded on the earlier counts, it’s something of an academic point.
Derrah said he’d received no instructions from Burden to waive the new bail hearing, so he suggested scheduling it for Monday.
McGrath said she’s going to be on vacation for three weeks starting Monday, but she’ll check with her chief judge to see if another outside judge can handle the bail hearing, which she scheduled for Monday morning.
Though there was no sound coming from the video feed showing Burden at the jail, he was clearly enraged at the turn of events.

I was the first reporter on the ground for a news story that’s made international headlines. An active shooter, a security perimeter, rumours of police officers down.
What I didn’t know at first was that one of those fallen officers was a family friend.
Four people are dead, two of them Fredericton Police Force officers. Const. Robb Costello and Const. Sara Mae Burns died protecting others in a scenario previously thought to be unimaginable for Fredericton.
Robb was a friend. Sure, I’m friendly with a lot of city police officers, given my job as the courts/crime reporter for the Daily Gleaner. But I knew Robb better, had a closer bond with him.
Robb - he always insisted on two Bs in his name - grew up in Sussex, just as my wife did. They were friends throughout junior high and high school, and when we started dating 15 years ago, it wasn’t long before I discovered her schoolmate was on the police force here in Fredericton. I encountered him often in court, and his friendship with my spouse-to-be made for a slightly stronger connection between reporter and constable.
I constantly teased Robb that I was privy to secrets that no one else in Fredericton knew about. I’d seen the photos of the tall afro and the MC Hammer parachute pants. I’d read the lyrics of the rap he’d written in high school. He was a guest at my wedding in Sussex, and thanks to the coincidence of mutual friends, we ran in the same social circles in Fredericton.
Robb was always all smiles when I’d run into him or when he’d get together with my wife and other friends from back home for lunch or a mini-reunion. But there was also a mischievous glint in his eye when he’d smile. That hint of mischief just made you like him even more.
He was a devoted dad to two beautiful young women - not girls anymore, but they were his little girls all the same. He took on the role again to his new partner Jackie’s two kids when they got together several years ago.
Robb served in various divisions of the Fredericton Police Force over the years, among them patrol and major crimes. He was also seconded for a couple of years to the RCMP’s Internet Child Exploitation unit. Though still a member of the Fredericton force, he worked with the Mounties hunting down people who accessed and distributed child pornography and predators who sought out young victims online.
Robb proved himself a hero in the end, rushing into danger to help people he didn’t even know. But he already was a hero several times over - to his kids, to his common-law spouse Jackie, to his mom Dolores, to his friends, to the people of Fredericton and all of New Brunswick.

This horrific event has put Fredericton in the minds and hearts of Canada and even other parts of the world. Prime Minister Justin Trudeau has acknowledged our pain, and CNN has turned its attention to our small provincial capital.
It’s the sort of situation every reporter thinks about. I was getting messages from reporters and news producers from all over the country and even overseas about the story.
But as soon as I discovered Robb was one of the fallen officers - which I learned hours before they were identified publicly - I knew it wasn’t my story anymore. My reaction was guttural and immediate. I worried for my wife, how she’d react when I told her. I pictured the wave of sorrow that would spread out among our friends as a physical force, knocking them over, one by one.
I was too close to it; ethically, I couldn’t cover the news story anymore.
But it doesn’t matter.
Robb is gone, and others’ loved ones are dead and injured. I just wish a good friend, a good partner and a good father was still here, and that I’d had another routine day at work.

A Renous man is facing a serious criminal charge stemming from a fatality alleged to have been caused by his dangerous conduct at the wheel last fall.
Roderick Gerard Hallihan, 53, of Route 108 in Renous, was charged criminally by the RCMP last month with dangerous driving causing the death of Mackenize Green on Sept. 17, 2022,, as well as driving without due care and attention, an infraction under the provincial Motor Vehicle Act.
Hallihan wasn’t present when his case was called for the first time in Fredericton provincial court Wednesday, but Fredericton criminal defence lawyer Sabrina Winters appeared on his behalf.
She said she’s received some disclosure of the Crown file but is still seeking further information, so she asked for an adjournment.
Judge Cameron Gunn set the matter over to Aug. 30 for election of mode of trial and pleas.

The charges stem from an accident in the Youngs Cove area last fall, about 40 kilometres east of Fredericton.
In a news release issued last fall, the RCMP reported a 24-year-old man from Mill Cove - later identified as Mackenzie “Mack” Green - died as a result of a two-vehicle collision.
On Sept. 17, 2022, at approximately 3 p.m., members of the Sussex RCMP responded to a report of a two-vehicle collision between a car and a pickup truck near the intersection of Route 10 and Bagdad Road,” the release said.
“The driver of the car, a 24-year old man, was transported to hospital with what were believed to be serious injuries. The passenger of the car was also transported to hospital with minor injuries.”
The Mounties reported the driver and sole occupant of the truck was uninjured.
Green died from his injuries Sept. 18.
“The collision is believed to have occurred when the driver of the car made a sudden stop, causing the truck to collide with the rear-end of the car,” the news release stated.
“The car then rolled into the ditch.”
In addition to RCMP officers, members of the Coles Island and Cumberland Bay fire departments, as well as Ambulance New Brunswick personnel, were on the scene, and the New Brunswick Coroner's Office assisted in the investigation.

A Grand Lake man accused of firing a shotgun in an effort to allegedly kill another man last month postponed his bail hearing Tuesday.
Rodney Michael Dickinson, 53, of Bridge Street in Grand Lake, formerly known as Chipman, was scheduled to go through a bail hearing in Fredericton provincial court Tuesday.
He faces RCMP charges of attempting to murder Paul Belliveau with a shotgun; discharging that shotgun at Belliveau with intent to wound, maim or disfigure him; using the gun in a careless manner; possessing it to commit an offence; and discharging it at a Grand Lake residence on Pleasant Drive knowing there were people inside.
Those charges stem from a July 23 incident in Grand Lake that prompted the Mounties to issue an Alert Ready emergency message advising residents of the recently amalgamated communities of Minto and Chipman to lock their doors and remain in their homes due to the risk posed by someone with a firearm.
Dickinson also faces other charges related to those alleged events: possessing the shotgun without a licence, being the occupant of a car in which he knew there was a firearm, driving with an elevated blood-alcohol level and driving while prohibited by a court order.
After his arrest and the charges being laid in court July 24, the Crown objected to Dickinson’s release.
Rather than proceed with the bail hearing Tuesday, though, the defendant asked for the hearing to be set aside, reserving his right to ask for it to be held at a later date if he so chooses.
Judge Cameron Gunn remanded Dickinson again, and he adjourned the case to Sept. 1 for election of mode of trial and pleas.

The RCMP in Oromocto is hoping members of the public can provide information to help officers locate a teenager who’s been missing since Monday.
“Isabella Scott was last seen on Aug. 7, 2023, at approximately 1:30 p.m., near a residence on Enniskillen Drive in Oromocto,” the RCMP stated in a news release issued Tuesday.
“She was reported missing to police later the same day.”
Officers have pursued several leads in the effort to find the girl, the release said, but to no avail.
“Police and her family are concerned for her well-being,” it said.
Isabella is described as being about 5’2” (157 centimetres) tall, weighing about 110 pounds (50 kilograms), with green eyes and long red hair.
“She may have been wearing a sweatshirt and jeans when she was last seen,” the release said.
Anyone with information on her whereabouts is urged to contact the Oromocto RCMP at 506-357-4300.

A Penniac man charged in a December 2021 fatal shooting in Fredericton found himself without legal counsel Tuesday, as his lawyer told court he had a conflict.
Travis James Snowsell, 26, of Penniac Road, faces a second-degree murder charge in the death of Corey Christopher Markey, 21.
He and a co-accused - Joshua John McIsaac, 33, also of Penniac Road - were charged jointly in the homicide case in late June.

The matter was back in Fredericton provincial court Tuesday afternoon, as Fredericton criminal lawyer T.J. Burke, who’d been retained as Snowsell’s defence counsel last month, said he’d run into an issue in the case.
“I have to be removed as counsel of record for my client, your honour,” Burke told Judge Lucie Mathurin.
He said he’d taken on Snowsell as a client under a legal aid certificate, but after some discussion, he realized he couldn’t continue as his lawyer due to a potential conflict.
“Not an actual conflict, but a perceived conflict,” Burke said.
He didn’t detail the nature of the conflict.
However, Burke said he’d been in contact with Saint John criminal defence lawyer Brian Munro, who expressed a willingness to take on the case in his place.
Burke said he’d advised staff at the Legal Aid Services Commission of New Brunswick of that development, and he expects the agency will issue the certificate to Munro.
Snowsell, who appeared in person in court Tuesday as well, and he acknowledged that Burke had advised him of the issue that had arisen.
Mathurin, after confirming that, granted Burke’s motion for removal.
No disclosure yet
McIsaac was also present in court for Tuesday’s proceedings.
He’s represented by Saint John defence lawyer Nathan Gorham, and Alexandra Youssef, an associate from Gorham’s firm, was on hand to act as his agent for Tuesday’s proceedings.
Youssef told the court her firm is still waiting on disclosure from the Crown on the Markey murder file.
“We have not received anything,” she said, noting she’d been advised by the prosecutors’ office it hadn’t received a file from the Fredericton Police Force as yet.

McIsaac and Snowsell are currently serving federal prison sentences on unrelated charges, and both are incarcerated at Dorchester Penitentiary.
Court heard previously they’d been cellmates at the New Brunswick prison, but upon being charged in Markey’s murder, a judge imposed a no-communication order between them, requiring Correctional Service Canada to separate them in the institution.
During Tuesday’s proceedings, they were kept in custody on opposite sides of Courtroom No. 5 at the Justice Building. However, they were held in the same cellblock at the courthouse before and after their court appearance, and they were transported from the building in the same van.
Markey, 41, was shot on Paul Street in Sitanisk (St. Mary’s) First Nation on Fredericton’s north side at about 12:30 a.m. on Dec. 21, 2021. He succumbed to his injuries in hospital eight days later.

McIsaac is also charged in another murder case. He and Erica Blyth, 40, of Wasson Road in Newcastle Creek near Grand Lake, face a joint first-degree murder charge stemming from the Jan. 28, 2022, death of Brandon Patrick Donelan.
McIsaac is represented by Gorham on Donelan murder case as well, and Burke represents Blyth on that file.
Youssef and Burke told the court they hadn’t received disclosure in that case either.
As Blyth’s next court date is set for Sept. 6, Mathurin set McIsaac’s and Snowsell’s matters to that date as well.
Authorities, including the RCMP, launched a significant search of the Minto and Chipman area for Donelan, 27, after he was reported missing to police Jan. 30, 2022.
His body was found in a wooded area along a snowmobile trail in the Grand Lake area March 31, 2022.
Blyth and McIsaac are also barred from contact with one another until the case against them concludes.

A Rusagonis man facing 11 indictable charges alleging sex-related offences involving an underage complainant will stand trial in superior court in several months’ time.
Evan Sandwith, 21, of Noble Court, elected earlier this year to be tried before a Court of King’s Bench judge alone on 11 counts, and he appeared at the Burton Courthouse for King’s Bench motions day Tuesday to confirm his trial dates.
Justice Thomas Christie noted Sandwith’s five-day trial is scheduled to begin March 11, though the defendant will appear before the Court of King’s Bench on Nov. 15 for a pre-trial conference.

Sandwith faces the following charges:
- sexual assault on the complainant - a minor female - with a knife, touching her for a sexual purpose and invitation to touch him for a sexual purpose, all on Aug. 20, 2021;
- another set of the same three offences but between Sept. 1 and 30, 2021, again involving the same girl;
- a third such set of those three charges against the same complainant, alleged to have occurred Sept. 25, 2021;
- and sexual assault and sexual touching against the same girl Sept. 11, 2021;
All counts, laid by the RCMP, refer to alleged events in or near Oromocto.
Though the charges against Sandwith are all indictable, he wasn’t given the opportunity to test the Crown evidence against him through a preliminary inquiry because the Office of the provincial Attorney General filed a preferred indictment.
That’s a rarely used avenue open to the Crown that forgoes a preliminary inquiry.
Sandwith has been before the courts twice before in recent years, accused of sexual offences against two other underage girls.
However, in both of those cases, he was acquitted.
Provincial court Judge Leslie Jackson acquitted him of September 2020 counts of sexual assault and sexual touching. involving a different underage female complainant.
In that case, the complainant testified she was 15 years old when Sandwith touched her breast over her clothes and attempted to put his hand down her pants.
Sandwith, who was 18 years old at the time of those allegations, denied he did any such thing, noting the girl was with a different male friend at Hazen Park in Oromocto when the events she described occurred.
The judge said he was left with a reasonable doubt as he found both the girl and the defendant to be credible.
Sandwith subsequently faced indictable charges of sexual assault and sexual touching involving another underage girl. Those RCMP charges alleged events in Oromocto between Oct. 29 and 30, 2020.
His Court of King’s Bench trial before Christie, without a jury, was scheduled to take place in June, but on the day it was to begin, the complainant and two other witnesses were a no-show in court.
The judge denied a prosecution motion for an adjournment. As the Crown then called no evidence against the defendant, Christie found him not guilty.
There are court-ordered publication bans in place in all three cases prohibiting the identification of the complainants.

A person dining at William’s Seafood in Fredericton sustained minor injuries after a car crashed through the wall of the restaurant at the supper hour Monday, police report.
Fredericton Police Force shift supervisor Cpl. Stefan DeCourcey told the Fredericton Independent on Monday evening that police, fire department and ambulance personnel were dispatched to the seafood restaurant on the Exhibition Grounds along Smythe Street at about 5 p.m. Monday after a single-vehicle accident.

The officer said a male driver crashed his car through the wall of the establishment, causing significant property damage.
“A customer received minor injuries,” DeCourcey said, noting that person was taken to the Dr. Everett Chalmers Regional Hospital.
When asked if any charges were expected to arise from the incident or what caused the car to crash through the wall, the officer said it was too soon to say.
“The investigation is ongoing,” he said.
William’s Seafood was closed as a result of the incident, and no one was answering the phone at the business Monday evening.
